Subchapter 1. General Provisions
1-3. RESPONSIBILITY FOR ENFORCEMENT
>a. Competitive service. Officials having delegated appointing authority are responsible for assisting in enforcing the restrictions for employees serving under their jurisdiction who occupy competitive service positions. Whenever it is found that an employee has, or may have, engaged in a prohibited political activity, immediate notification containing a brief statement of the facts and circumstances will be forwarded to the Special Counsel, Merit Systems Protection Board, 1717 H Street, N. W., WASH DC 20419, phone: (202) 653-7107. Information copies of the material submitted will be furnished to HQDA(DAPE-CPL) WASH DC 20310 and intervening levels of command.
b. Excepted service. Officials having delegated appointing authority are responsible for informing excepted service employees of the restrictions on political activity and informing major commanders or heads of Army Staff agencies, as appropriate, of suspected violations of these restrictions. Investigations of allegations of prohibited political activity and the determination of action to be taken as specified in FPM Chapter 733.7 is the responsibility of the major commander or head of the Army Staff agency concerned. <
